Abstract : While discrimination in hiring based on physical appearance has been an illegal practice since the enactment of the law of November 16, 2001, a number of studies have revealed the existence of this practice over time, which implies its persistence. This research is therefore interested in understanding this phenomenon by answering two questions. The first is how is this possible? By looking at the legal side of discrimination by analyzing the genesis of the French anti-discrimination legislative framework and the paradoxes that compose it; through the quantitative and qualitative analyzes of jurisdictional and extra-jurisdictional databases relating to discrimination in hiring according to physical appearance, we highlight the elements that limit or prevent appeals / complaints from victims and contribute to a persistence of this type of discrimination. But, that doesn’t explain it all. We focused on one particular area: the sale of sports goods and services. Because the employees who recruit are required to select only practicing sports candidates, how, considering the uncertainty that surrounds the recruitment procedure, could they not consider physical appearances to make their choice, and therefore not discriminate according to those? Through semi-structured interviews and the observation of several recruitment training sessions, we try to understand the action of these men and women which does not take place without reasons and does not exist without constraints. In addition to discovering the justifications that allow recruiters to repeat their discriminatory behavior, we study one of the socializing influences that actualizes a professional habit inviting them to discriminate.
